Season Pass Waiver 2024

Please read the waiver below and fill out the required fields found in the following form sections. All liability language from the waiver will apply to all persons listed below.

Refund Policy

  • For 2023-24 early season passes purchased before April 1, refunds may be issued until the opening of the 2023-24 ski & snowboard season. For first time season passholders, the refund will be less the $125 per person deposit which allowed you to ski the remainder of the 2023-24 season.  Reason for refund must be communicated to management before the refund will be issued. There will be a $50 processing fee for any refunds issued for renewing season passholders. Refunds will be issued by December 15, 2023.
  • No refunds will be issued after the 2023-24 season opening day.   
  • In the case of injury that occurs before opening day, 100% of the paid value of the injured person’s season pass will be forwarded to the 2024-25 season.  In the case of injury that occurs on or before January 15, 2024, 50% of the paid value of the injured person’s season pass will be forwarded to the 2024-2025 season.  A signed letter from the acting physician stating the pass holder’s inability to participate in skiing or snowboarding, must be presented to Swain in order for the pass transfer to occur.  For injuries that occur on or after January 16, 2024 that cause the pass holder the inability to use the season pass, no refunds or pass transfers will be issued.
  • There will be a $25 reprint fee for all lost or stolen passes.
  • Transfer or misuse of Swain Season Passes is considered theft of services and punishable by law and a fine of up to $1000.

 

2023-24 

TERMS AND CONDITIONS:

  • Family Rates are for husband, wife, and children/dependents under the age of 22 at time of payment, who are living at home or attending college full time.  Dependent persons are those claimed on your Federal Tax Return for 2022.
  • Anyone age 7 on December 1, 2023 must pay the full rate.
  • College students must present or send a copy of photo college ID before Student Pass will be issued
  • Ages 75 & Up at time of payment are FREE anytime, photo ID required
  • Swain has the right under Article 18 of the New York State Obligations Law to remove from the ski area and /or deny skiing/snowboarding privileges to anyone whose conduct, excesses or attitudes, as determined by Management or Patrol create a nuisance for themselves or others.  In such cases, no refunds shall be issued.
  • Skiers, snowboarders, and lift passengers are governed by the New York State Safety in Skiing Code, Article 18 of the NYS Obligations Law.  Before affixing your pass or allowing any pass to be affixed to your person, your attention is directed to a posted “Warning to Skiers” sign which is stated below and displayed where tickets are purchased.  New York State Law requires you to seek, read, review, and understand the “Warning to Skier” before you decide to participate in the sport of skiing or snowboarding.

Warning: Downhill skiing and snowboarding,  like many other sports, contains inherent risks including, but not limited to the risk of personal injury, including catastrophic injury, or death, or property damage, which may be caused by variations in terrain or weather conditions; or, surface or subsurface snow, ice, bare spots or areas of thin cover, moguls, ruts, bumps, or other persons using the facilities; or rocks, forest growth, debris, branches, trees, roots, stumps; or other natural objects or manmade objects that are incidental to the provision or maintenance of a ski facility in New York State. New York law imposes a duty on you to become apprised of and understand the risks inherent in the sport of skiing, which are set forth above, so that you make an informed decision of whether to participate in skiing notwithstanding the risks. New York also imposes additional duties upon you, to which you must adhere, for the purpose of avoiding injury caused by any of the risks inherent in skiing. If you are not willing to assume all of these risks and abide by these duties, you must not participate in skiing or snowboarding at this area.

YOUR RESPONSIBILITY CODE:

Always stay in control, and be able to stop or avoid other people or objects.

People ahead of you have the right of way.  It’s your responsibility to avoid them.

You must not stop where you obstruct a trail, or are not visible from above.

Whenever starting downhill or merging into a trail, look uphill and yield to others.

Always use devices to prevent runaway equipment.

Observe all posted signs and warnings.  Keep off closed trail and out of closed area.

The signatures on this waiver certify that all passholders listed have read and understand the Terms & Conditions, Warning to Skiers, Your Responsibility Code, and Refund Policy and agree to abide by them.  Parents’ signatures certify that they have explained the risks and warnings to minors (under the age of 18) in age appropriate terms and the minors have agreed to assume said risks.
